1. Definitions

In these Terms and Conditions:

• "Capture Studios" refers to Capture Studios, located at 212 Bell Street, Seattle, WA 98121.
• "Client" refers to any individual or entity booking photography services with Capture Studios.
• "Services" refers to any photography services provided by Capture Studios, including but not limited to portrait photography, wedding photography, commercial photography, and event photography.
• "Session" refers to the agreed-upon time and date for the provision of services.
• "Photographs" refers to all images created by Capture Studios during a session.

2. Booking and Payment

A booking is considered confirmed upon receipt of a non-refundable deposit of 50% of the total service fee. The remaining balance is due on or before the session date. Payment can be made via credit card, check, or cash. For commercial projects, specific payment schedules will be outlined in the project proposal.

3. Cancellation and Rescheduling

If the Client cancels the session, the deposit is non-refundable. If Capture Studios cancels the session due to unforeseen circumstances, the Client will receive a full refund of the deposit or the option to reschedule the session at no additional cost. Rescheduling is subject to availability. Clients must provide at least 72 hours' notice for rescheduling a session, otherwise, an additional fee may apply.

4. Copyright and Usage

Capture Studios retains all copyrights to the photographs. The Client is granted a license to use the photographs for personal use, including printing and sharing on social media. Commercial use of the photographs requires written permission from Capture Studios and may be subject to additional fees. The Client may not alter, edit, or modify the photographs in any way without prior written consent from Capture Studios. Any unauthorized use of the photographs will be considered a copyright infringement.

5. Model Release

The Client agrees to sign a model release form, granting Capture Studios permission to use the photographs for promotional purposes, including but not limited to website display, social media marketing, and advertising. If the Client does not wish to grant this permission, they must notify Capture Studios in writing prior to the session. For minors, a parent or legal guardian must sign the model release form.

6. Liability

Capture Studios is not liable for any loss or damage to personal property during a session. While we take precautions to ensure the safety of our clients, we are not responsible for any injuries sustained during the session. The Client is responsible for the behavior of their guests during the session. Capture Studios reserves the right to terminate the session if the behavior of the Client or their guests is deemed inappropriate or unsafe. In such cases, no refund will be issued.

7. Delivery of Photographs

Edited photographs will be delivered to the Client within 14 business days of the session date, unless otherwise specified. The photographs will be delivered via an online gallery, from which the Client can download the high-resolution images. Capture Studios is not responsible for the loss of photographs once they have been delivered to the Client. It is the Client's responsibility to back up the photographs.

8. Retouching and Editing

All photographs will be professionally edited by Capture Studios. Standard editing includes color correction, exposure adjustment, and minor blemish removal. Additional retouching services, such as extensive skin smoothing or object removal, are available at an additional cost. The Client must request additional retouching services prior to the delivery of the photographs. Capture Studios reserves the right to artistic license in the editing process.

9. Force Majeure

Neither party shall be liable for any failure to perform its obligations under these Terms and Conditions if such failure is caused by an act of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Seattle, Washington.

11. Amendments

Capture Studios reserves the right to amend these Terms and Conditions at any time without prior notice. The most current version of the Terms and Conditions will be posted on our website. It is the Client's responsibility to review the Terms and Conditions prior to booking a session.
